Spelling, Grammar, Letter Order & Similar Errors
Typically we sew, cut or print the letters in the exact order they are entered in the system by the customer.  We can sometimes catch obvious errors but cannot guarantee if you make an error we will catch it.  Thus it is vitally important that you review all lettering and spelling before you submit your orders.  We cannot be held responsible for customers entering incorrect information in while placing their orders.  If you do catch an error please let us know as soon as possible and every effort will be made to make the change before production begins.  Once production begins or in the case of items shipped directly from our suppliers once the order it transferred to them the change cannot be made and the customer will be responsible for payment for the item.

Customary Orders of Letters in a Monogram
Typically three letter monograms in which the middle initial is larger than the other two feature the initials in order of first name, last name and finally middle name.  Sometimes when using more masculine fonts or monograms in which all three letters are the same size (like Times Roman or Block) the initials would typically go first name, middle name and then last name.  When doing monograms for wedding gifts most people tend to use the new initials for the bride, but other variations like the brides first initial, the Initial for the new last name and then the grooms initial are not uncommon.  When in doubt what to do contact one of our customer service representatives for additional help.

Embellishment Placement
In most cases there will be a note in each product listing if the item can be personalized along with a description of were the personalization is normally placed.  With that said if there is somewhere else you would like to have the personalization placed please contact one of our customer service representatives or put a note on your order.  Every effort will be made to meet your request.  Sometimes, this may result in an adjustment to the personalization cost.  If that is the case we will either refund the overpayment or send out an additional invoice for the difference.

Estimated Production Time
Normally most of our personalized items are ready for shipment or pick up within seven to ten business days of receiving completed or confirmed artwork, or order date if such information is not needed. In case of large orders or at times of peak business it may take significantly longer. On orders under five items you will be informed if it will take more than a ten business days (from approved artwork, if required) to complete along with an estimated completion date.

Use of Trademarks, Logos, Copyrighted Material or Other Materials Covered By Intellectual Property Laws
The customer represents and warrants to Purple Turtle Gifts that they have the right to use, copy and distribute each trademark, trade name, logo, statement, graphic, artwork, name, photograph, portrait, picture or illusion of any person or any other intellectual property in the way it is to printed on, sewn, or otherwise applied to the products ordered by the user or customer from Purple Turtle Gifts. 

The customer warrants that, in obtaining the material and submitting it to Purple Turtle Gifts for reproduction, they have not violated the property rights of a third party. The customer further agrees to indemnify and hold harmless Purple Turtle Gifts and its associated companies and its owners, officers, employees and agents from any suit, demand, claim, loss, liability, damage or expense made against Purple Turtle Gifts by reason of breach of this warranty, and also agrees to pay any judgment or settlement offer resulting from any suit, demand, or claim and to pay any attorney's fees incurred by Purple Turtle Gifts in defending against any such suit, demand or claim.

The burden of determining that any material is not protected by trademark or other proprietary right rests solely with the customer. The customer is solely responsible for obtaining proper permissions and licenses, except as may be permitted by copyright law, from third parties whose rights may be violated or infringed upon by the use of any material protected by trademark, service mark, copyright or other proprietary rights.

A customer may not use any logo or other graphic material in a manner that may infringe upon copyright, trademark, service mark or other proprietary mark. A customer also may not use any logo or trademark in a vulgar, libelous, disparaging or otherwise unlawful manner.

Purple Turtle Gifts assumes no responsibility for damages or any wrongdoing that the customer may cause using a logo, trademark or copyrighted item. The customer further agrees to indemnify and hold Purple Turtle Gifts harmless from and against any suit, demand, claim, loss, liability, damage or expense made against or incurred by Purple Turtle Gifts by reason of the unauthorized, improper, or illegal use of any logo or trademark or copyright that is printed on, sewn or otherwise applied to merchandise ordered or purchased by the customer through Purple Turtle Gifts.

It is ultimately the buyers responsibility to make sure they have complete and unrestricted rights to use such items. Purple Turtle Gifts retain the right to ask for proof of such legal right before accepting any order and to cancel any order made if it is discovered purchaser did not have such rights. The purchaser will become responsible for reimbursing Purple Turtle Gifts any cost incurred in processing the order and any money paid at time of placing the order will not be refunded.

Return Policy on Personalized Items
One of the great things about many of our items is they can be personalized to include your personal touch, like an engraved message, an embroidered design, a monogram or even a digitally imprinted logo. While every effort will be made to get things right by the nature of things we will not be able to give refunds or credits on items that have been personalized or embellished in any way. In most cases you will be contacted by one of our designers and your order will be reviewed. Any custom artwork will be sent to you for approval before we start work. Upon approval of the design or start of work your order cannot be canceled. Also, note that the processes do lend themselves to slight variations in colors or finishes. While we try to employ the highest quality controls and top of the line processes by being personally made you can expect slight variation from one item to another in color and final product. Therefore, please verify all names, all color selections, and all designs before submitting your order.

Refund of Digitizing, Artwork Preparation or Other Miscellaneous Fees

Digitizing Services
Digitizing fees are the cost, if any, associated with converting an image, logo, monogram or other item into a file format that will allow it to be embroidered on a specific type of item, on a particular fabric at a specific size. Such fees are normally -ime fees for the creation of a file for a specific design, size and material to be stitched on. Variations in size, material, design or type of item from which we were originally asked to digitize the design, may sometimes, but not always, incur additional digitizing fees to make sure the file will stitch correctly. All effort will be made to minimize stitch count while being sure not to compromise the quality of the embroidered image. A sample of the final digitized image can be obtained free of additional charge before production starts if the customer so chooses. All digitizing fees are due and must be paid for prior to starting any work on your file and are not refundable. Purple Turtle Gifts, its agents and parent company are not responsible for designs run on fabrics other than those for which they were originally digitized or for any size deviations made by the end user or its agents, nor are we responsible for damaged goods resulting there from. We are happy to work with you to correct any problems or make any changes requested prior to production. Once artwork approval has been obtained and production has been schedule designs cannot be changed or altered without incurring additional fees.

Purple Turtle Gifts retains the rights to all digitized stitch files 
It is our policy not to transfer such files to outside third-party embroiderers unless said party is doing contract work directly for Purple Turtle Gifts. Furthermore, Purple Turtle Gifts also uses 3rd party digitizing services as needed. In such case the property rights remain with said digitizing company until such time they release the designs subject to their policies.

Design, Photo Editing or Other Miscellaneous Production Fees
Purple Turtle Gifts tries to minimize all production fees, however if such services are needed they will be specified upfront before starting work along with an estimate and a description of the service to be performed. You will never be hit with a fee without such documentation and chance to decline the service. These fees will always be due and payable upfront before work begins and are not refundable. In a case where a time estimate is used in calculating the initial amount due a customer will be refunded any money paid that was attributable to time that was not needed to complete the task. Thus, you will only pay for time that was actually needed to complete the task. However, if it appears the project will take more time than was originally estimated the customer will receive notice explaining why the additional time is needed and if applicable any additional charges that will be incurred. At this point the customer can ask the work be halted in which case there would be no further cost incurred or they can agree to the additional work in which case they will be liable for any additional costs.
